Arbitration proceedings are confidential and arbitrators decide on disputes instead of ordinary courts. As a rule, arbitration proceedings result in a legally binding decision in a single instance and usually take the needs of the companies into account more individually. Duration and costs can be better estimated. At the end of the proceedings, there is a binding arbitral award that has the same effect on the parties as a judgment of the ordinary courts. However, this requires that the respective staes involved have joined the so-called New York Convention of 1958 (currently over 170 signatory states).
An impartial mediator assists entrepreneurs in working together with the opposing party to reach asolution which is mutually accepted. This allows to retain full control over the outcome and to find creative, situation-oriented solutions. Mediation is a way to resolve conflicts efficiently without the publicity of ordinary court proceedings.
The process of conducting an independent expert assessment is a special procedure in which an independent and neutral expert is called in to clarify technical or specialist issues. The expert draws up an expert opinion that is binding for the parties involved. This procedure should not be mixed up with the work of independent experts as arbitrators or in offering expert advice to the arbitration panel.
A neutral third party facilitates communication between the parties to reach an amicable settlement. This method is particularly flexible and helps to preserve business relationships without the need for a judicial decision. Conciliation is ideal for companies that prefer confidentiality and a flexible, context-specific solution.
